Driving license suspension due to cannabis consumption
What the Higher Administrative Court of Munich has decided on the new legal situation
The Administrative Court stated in its decision 11 CS 25.203 of 23 April 2025 It is clear that withdrawal notices issued near The old law continues to apply to laws passed before the Cannabis Act comes into force (April 1, 4); there is no subsequent “amnesty.”
At the same time, the court emphasizes: Whether you are suitable again today will only be examined in the renewal procedure, not in the old lawsuit.
THC limit 3,5 ng/ml: Only above this value is a current influence of cannabis suspected.
Regular consumption ≠ automatically unsuitable: Without additional risks (mixed consumption, mental illness), the driving license authority can waive an MPU.
No transitional provisionsAnyone who applies for a new license today will benefit directly from the new, more lenient review criteria.
| Initial situation | What is available now |
|---|---|
| Withdrawal before April 1, 4 | Application for reissue under new limits – often without an additional blocking period. |
| Pending legal proceedings | Change of strategy: Terminate the main proceedings, direct resources to reissuing the decision. |
| Negative MPU report due to lack of abstinence | Screening instead of abstinence: Prove that you can separate consumption and driving. |
| Medical cannabis | Have it checked whether taking medication prescribed by a doctor is still relevant to your ability to drive. |
