The emissions scandal has been affecting the lawyers at our law firm in Regensburg, Landshut, Erfurt, Munich and Fürth for several years now. And there is still no end in sight: Mercedes-Benz now has to recall over 100.000 diesel vehicles following orders from the Federal Motor Transport Authority (KBA).
Problem point thermal window
The reason for the mass recall of Mercedes vehicles is the installation of a so-called “thermal window”. This is a function in the engine control system, which means that the vehicle's exhaust gas purification system is only functional within certain outside temperatures. This is a software strategy that has already been the subject of many diesel lawsuits. The thermal window actually significantly increases nitrogen oxide emissions at temperatures around the annual average.
Recall notice from the KBA, the vehicle is threatened with decommissioning
The result: Numerous car owners are now informed by the KBA about the measures to be taken. The KBA will issue mandatory recall orders and initiate software updates. If the addressees do not comply with these measures, there is a risk - after repeated requests - that the vehicles will be shut down.
Outlook
But the new Mercedes recalls due to the thermal window are probably not over yet: this type of engine software has also been installed in numerous other car manufacturers. The diesel scandal is likely to experience a renaissance, and claims for damages against automobile manufacturers are now more relevant than ever.
The KBA's new decision to recall numerous Mercedes vehicles will leave many car owners at a loss - at the latest when the notice arrives with the threat of decommissioning.
