The Higher Regional Court (OLG) Cologne has massively strengthened the rights of Mercedes drivers in the emissions scandal with a ruling dated November 05.11.2020, 7 - 35 U 20/XNUMX.
In the present case it was specifically about a Mercedes Benz Vito in the Marco Polo version. The court ruled that Daimler had damaged the Mercedes driver in an immoral manner through the use of impermissible defeat devices. The court stated that there is a claim for damages against Daimler according to § 826 BGB. As a result, Daimler has to take back the Mercedes Benz Vito at issue and pay the driver a high amount of damages.

Daimler could not refute the accusation that in addition to the well-known thermal window, many other inadmissible cut-off devices are used. So could not invalidate Daimler:
The OLG Cologne makes it clear that the plaintiff has specifically and comprehensibly submitted against Daimler that the control mechanisms of his Mercedes use several different shut-off devices, which mean that the limit values for nitrogen oxides can ultimately only be reached under test bench conditions. In real operation on the road, this inevitably falls far short of this. The OLG Cologne also highlighted the particular reprehensibility of Daimler's actions! By hiding the installation of the inadmissible defeat devices from the Federal Motor Transport Authority (KBA), Daimler obtained an inadmissible approval of their vehicles.
Since we represent a large number of clients against Daimler, we also have insights into the effects of the so-called "engine update" from Daimler. Our clients regularly complain - after the engine update - about one poor engine performance, defective EGR valves, frequent regeneration of the particulate filter and much more.
