The Higher Regional Court (OLG) Cologne has massively strengthened the rights of Mercedes drivers in the emissions scandal with a ruling dated November 05.11.2020, 7 - 35 U 20/XNUMX.
In the present case, it was specifically a Mercedes Benz Vito in the Marco Polo version. The court ruled that Daimler immorally harmed the Mercedes driver by using illegal defeat devices. The court explained that there is a claim for damages against Daimler under Section 826 of the German Civil Code. As a result, Daimler had to take back the disputed Mercedes Benz Vito and pay the driver a high amount of damages.

The OLG Cologne makes it clear that the plaintiff has specifically and comprehensibly submitted against Daimler that the control mechanisms of his Mercedes use several different shut-off devices, which mean that the limit values for nitrogen oxides can ultimately only be reached under test bench conditions.
