There are more and more myths and legends about who is still allowed to remove tattoos with a laser and with what training, further education or training. We bring light into the darkness!
Granted, with the Ordinance on protection against harmful effects of non-ionizing radiation when used on humans (NiSV) the legislator has not necessarily covered himself in glory. The NiSV raises more questions than it answers.

As a result, these two professional groups are the only ones who are allowed to remove tattoos using lasers. We must first question the purpose of tattoo removal. This is important because it is the only way to decide whether the Application areas to § 1 NiSV is opened. This is what § 1 Para. 1 NiSV says:
"(1) This Ordinance applies to the operation of systems for the application of non-ionizing radiation to humans, which cosmetic or other non-medical purposes be used commercially or within the framework of other economic undertakings. It does not apply to the operation of UV radiation devices within the meaning of the UV Protection Ordinance."
Accordingly, the doctor's reservation according to § 5 paragraph 2 NiSV only applies if a tattoo is to be removed for cosmetic or other non-medical purposes. If the tattoo is removed for medical purposes, the NiSV does not apply, which means that the doctor's reservation does not apply either. Consequently, naturopaths could also carry out this treatment according to Section 1 (2) of the Heilpraktikergesetz:
"(2) Practicing medicine within the meaning of this law is any professional or commercial activity to diagnose, cure or alleviate illnesses, ailments or bodily injuries in humans, even if it is carried out in the service of others."
Other professional groups (beautician etc.)
These professional groups are no longer allowed to carry out tattoo removal using a laser from any conceivable point of view. Because either the removal is medical. Then only doctors and naturopaths are allowed to do it. Or the removal is cosmetic, in which case only doctors with appropriate further or advanced training according to § 5 Para. 2 NiSV are allowed to do it.
