Hardly a day goes by in German road traffic without any Accident comes. According to the Federal Statistical Office, around 2015 there was an average traffic accident every 13 seconds. No wonder that the number of accidents rose steadily in the years that followed, reaching a new negative record of around 2019 million traffic accidents in 2,69. Unfortunately, these are not minor rear-end collisions, but increasingly accidents with moderate to severe property damage and personal injury. It can therefore be said that a traffic accident can happen to anyone. It is all the more important to know what to do in the event of an emergency.
Immediately after the accident
Immediately after an accident, hazard warning lights must be switched on, the scene of the accident secured and, if necessary, emergency services and the police notified. Evidence should then be secured, especially when the police are not there - for example in the event of very minor property damage. Ideally, you should take good quality photos of the damage and the conditions at the scene of the accident. Furthermore, an exchange of information with the other party involved in the accident is indicated: the data of the vehicle driver, the owner, the respective motor vehicle liability insurance should be exchanged and, of course, the license plates should be noted. Be careful with - especially written - acknowledgments of guilt: under no circumstances should you give it prematurely. In most cases it is not possible to answer this question correctly in the aftermath of the accident - this should be left to a specialist afterwards. Such an acknowledgment can have serious consequences in the context of the subsequent claims settlement, such as the (partial) loss of insurance cover.
Claims settlement
After the accident has also been reported to your own insurer, an expert should determine the amount of damage. Then you can get into claims settlement. It is best to outsource this effort and work comfortably and commission a traffic attorney - he will take care of your claims settlement. The costs for this are ultimately borne by the person who caused the accident, but in any case your traffic legal protection insurance, if one exists. In this respect, you have the best prerequisites for a worry-free settlement of the damage.
The most important thing, however, is that the traffic attorney also knows what you are entitled to after a traffic accident. This is particularly worthwhile in cases in which you are the victim of the accident. In addition to reimbursement of the (fictitious) repair costs or the vehicle value in the event of a total write-off, you can also be entitled to reimbursement of the depreciation due to the repair, reimbursement of rental car costs Loss of use compensationif you don't hire a car - just to name a few items. If there is also personal injury, your lawyer will also take care of the claim for appropriate compensation for pain and suffering, housekeeping damage and loss of earnings. As you can see: There are many different claims that can be asserted and that should definitely be used.
At the end
Last but not least: under no circumstances should any offer made by the motor vehicle insurer of the person causing the accident be accepted without a legal examination. Because these usually report to the injured party very early on, ensure rapid settlement and, of course, are careful to keep the damage to be paid out as low as possible. In addition, in contrast to the accident victim, the insurer has experience in handling traffic accidents. As a result, it is not uncommon for the injured party to unconsciously cut off his own claims due to a supposedly lucrative offer from the opposing insurer.
Therefore, in the event of a traffic accident that is already severe for you, let our lawyers accompany you and place the claims settlement in our hands. We are happy to assist you with advice and action and assert your claims for you in the best possible way!
